Burley Parish Council’s response to the decision to build 500 homes at Sun Lane

At its Extraordinary Meeting on Tuesday 9th March, the Parish Council agreed to commission legal advice, on behalf of the Village, to explore whether there was a possibility of any avenue of legal challenge to the Secretary of State's decision to allow planning permission to be granted for the Sun Lane development. This legal opinion has been sought from a firm of specialist solicitors experienced in challenges of this nature. Following their comprehensive analysis of all aspects of the case (the original planning permission from BDMC, the Inquiry, the representations, the Inspectors report and recommendations for approval, the previous quashing of the permission, the high court challenge, the new information presented both for and against the proposal, and the various updates to both national guidance and local plans, and finally the new Secretary of State's decision to allow planning permission) they have concluded that there is no avenue of challenge available to pursue.
